Q-Legal

Q-Legal: Getting a DUI is not fun, and is costly

Social gatherings often involve alcohol, and sometimes, illegal drugs. It can be hard to pace yourself or abstain when you are having a great time at a party or restaurant. Unfortunately, “One more for the road,” can be one too many to make it home safely.

Q-Legal: Big news for transgender community

We use the acronym “LGBT” to identify lesbian, gay, bisexual and transgender individuals as a community of people with common issues and concerns. But within that group, many transgender issues are unique – and can be highly complicated, requiring a level of legal and emotional support beyond that of most LGB persons. Here are some current items of interest:

Q-Legal: Be safe, not sorry when you travel

The recent incident of a gay couple on a cruise ship in a foreign port who were accused of public sex on the balcony of their stateroom reminds us to research the laws and customs of other countries, and to be very aware of our actions that might be misconstrued. Here are some important points to consider when you travel – along with some tips to help prevent crooks from taking advantage of you.

Q-Legal: Can you save your home through bankruptcy?

Two key markers of financial distress are bankruptcy and home foreclosure rates. The mortgage crisis of the past several years has hit Californians hard, and is a major cause of the large number of bankruptcies filed here. But we may see a gradual reduction in the number of foreclosures as federal and state regulations begin to protect a larger number of homeowners with upside down mortgages.

Q-Legal: Legal tidbits and updates affecting the LGBT community

Are You Your Mother’s Keeper?

If you live in California or 27 other states, you may very well be responsible for your parents’ support and care. The concept of “filial responsibility” is the law in these states, and, although not often enforced in most of them, it shouldn’t be ignored. Coming out of the recession, many states are struggling with debt and budgets that won’t balance.

Q-Legal: Understanding landlord/tenant issues

If you own a residential property and rent it to someone else, you are a landlord. If you rent from someone who owns the property, you are a tenant. And if this takes place in the state of California, you are both subject to some of the most complex and nit-picky rules and regulations in the world. These laws have evolved over the past 150 years to preserve the rights of each of you, and to provide remedies when disagreements occur.

It is a legal minefield, and one that I avoid in my own practice.

LGBT seniors: Will we age in comfort?

Studies and articles on our aging population catch my attention from time to time. They concern me because I, too, will be a senior someday, and also because, as a professional, I have an obligation to provide the best legal advice about the issues of aging to my clients.

I am especially interested in ways to help our LGBT community manage their later years as comfortably as possible.

Here are three issues that have been in the news:

Conservatorship: Celebrities are just like us

Every now and then, headlines spotlight a celebrity who has entered the world of conservatorship – where courts determine if there are issues that a person can’t handle, and if someone else should be named a guardian or conservator of that person.

There are thousands of conservatorship actions in California every year, but most of them aren’t big news. It’s the actors, entertainers and other popular idols who get the press, the blogs and the YouTube exposure.

Seniors and retirees: Are you judgment proof?

The bankruptcy rate for Americans over age 55 is soaring. This age group now accounts for over 20% of all bankruptcies filed. Some analysts estimate that for every older person who files a bankruptcy petition, there are two more seniors who should, because of their dire financial straits.

What’s going on? Retirees used to be seen as financially stable, kicking back on their savings and pensions, mortgages all paid off – enjoying their golden years. But not any more.

Legal lawsuits run gamut from from serious to silly

Civil lawsuits, called “civil litigation” in legalese, are always with us. I don’t handle most types of litigation in my practice, but I am sometimes asked by prospective clients whether they have a “good case” and might win if they filed a lawsuit. Since this is not my area of interest, I usually refer people on to other attorneys experienced in these issues for an answer.
