Defending against HIV criminalization

NEW YORK -- The Center for HIV Law and Policy has released the first comprehensive analysis of HIV-specific criminal laws and prosecutions in the United States.

The publication, “Ending and Defending Against HIV Criminalization: State and Federal Laws and Prosecutions,” covers policies and cases in all fifty states, the military, federal prisons and U.S. territories.

The publication is intended as a resource for lawyers and community advocates on the laws, cases and trends that define HIV criminalization in the U.S.

Lambda Legal: HIV stigma and discrimination is still rampant in the U.S.

NEW YORK -- As the annual World AIDS Day approaches on Dec. 1, Lambda Legal has found that discrimination and stigma against people living with HIV/AIDS is still rampant in the United States.

The organization has released an evidence-based report on the continuing stigma and discrimination faced by people living with HIV to policy makers and advocates.

I still have sadness about my own lapse of judgment in a moment of passion that rendered me HIV positive in August of 2007. Now (November 2010) in my third month of taking ARV’s (antiretroviral medications), the fact that I am HIV positive is more real than ever.

Had I had it to do all over again, I would hope to remain vigilant to the safer sex practices that had been part of my life for decades. With this said, I feel the most important work of my life is taking place now.

Advances in medication have not only increased the lifespan for people living with HIV, but also the quality of our lives. Despite this good news, it has also brought new challenges that were not anticipated back when being diagnosed with HIV carried a prognosis of a much shorter lifespan.

HIV-positive retiree who was evicted from assisted living to attend White House meeting on AIDS and aging

WASHINGTON -- Lambda Legal client Dr. Robert Franke, who was evicted from a Little Rock, Ark., assisted living facility because he has HIV, has been invited by the White House to participate this week in a conference on HIV and aging.

Dr. Franke, a retired educator and former minister, will attend the meeting with his daughter, Sara Bowling, and Lambda Legal HIV Project Staff Attorney Scott Schoettes. Schoettes will speak on a panel addressing issues likely to affect seniors living with HIV.

Still no explanation from California state agency on release of confidential HIV information

SACRAMENTO -- The California Department of Health Care Services' (DHCS) has failed to provide a meaningful explanation for its illegal release of the names of some 5,000 HIV-positive Medi-Cal recipients to a third-party service provider, said attorneys at Lambda Legal, the American Civil Liberties Union of Northern California (ACLU-NC), and HIV & AIDS Legal Services Alliance (HALSA).

A letter delivered to the agency from the groups today warns that DHCS must immediately act to protect the confidentiality of HIV patients, or face further steps that could include legal action.

National AIDS Fund earns fourth consecutive 4-star rating from Charity Navigator

WASHINGTON -- Once again demonstrating its ability to efficiently manage and grow its philanthropic resources, the National AIDS Fund (NAF) has earned the coveted 4-star rating from Charity Navigator, America's leading charity evaluator.

This is NAF's fourth consecutive 4-star rating, the highest rating possible.

"Only nine percent of the charities we rate have received at least 4 consecutive 4-star evaluations," Ken Berger, Charity Navigator president and CEO, said in his letter to National AIDS Fund.
