The high cost of same-sex divorce

NEW YORK -- A patchwork of state marriage laws and the federal Defense of Marriage Act has made the process of unraveling a relationship extremely difficult -- and expensive.

A same-sex couple who marries in one state and later relocates to a state that doesn't recognize the marriage, for example, may be unable to get a traditional divorce. Often, they either have to move to the state where they married to establish residency or dissolve the marriage outside of the court system. Some states call this a dissolution of marriage instead of a divorce.

Denied divorce, some same-sex couples are "wed-locked"

On her wedding day, Jessica Port wore a tan and black dress to match the tan button-down shirt and patterned necktie of her spouse-to-be, Virginia Anne Cowan.

They had taken a vacation from their home in Washington D.C. to a San Francisco courthouse in 2008 to get married, since California had recently begun to allow same-sex marriages.

"We were just like every other couple, we really thought that this was it," said Port, 30, who works as a counselor at a special-education school. "We had nothing to worry about. We were just focused on marriage and future."

A gay divorce catches attention of Kenyans

The London gay wedding of Kenyan men Charles Ngengi and Daniel Chege Gichia sent shock waves throughout Kenya. There was outright and widespread condemnation of their marriage in Kenyan media through October 2009. And the pair were described as "the accidental gay rights trailblazers."

The good news is New York has joined the few states that allow gay marriages. Gay and lesbian couples from all over the country are flocking to the Empire State to “tie the knot” in wedded matrimony.

The bad news is that when marriages fail, and gay and lesbian couples seek a divorce, several states do not allow them to obtain divorces or annulments.

Most states and the federal government do not recognize gay marriages. Many same-sex couples are left without a remedy when they seek to end their relationships.
