SDGLN Poll: Readers think marriage equality will be next nationwide win for LGBT Americans

SAN DIEGO – A plurality of readers of San Diego Gay & Lesbian News who took our poll say that they believe that marriage equality will be the next nationwide victory for LGBT Americans.

Our poll question was: The next LGBT nationwide victory will involve: Marriage equality, Employment Non-Discrimination Act, Immigration equality, Transgender equality or Anti-gay bullying?

Victory for transgender immigration documents and marriage benefits

WASHINGTON -- U.S. Citizenship and Immigration Services (USCIS) on Friday issued a Policy Memorandum revising the treatment of gender designations for transgender people on their immigration documents.

The new guidance also makes clear that if a couple has married as a different-sex couple under state law, the federal government will continue to recognize the marriage for immigration purposes regardless of a person's subsequent gender transition.

The revisions update the Adjudicator's Field Manual, a guide binding all USCIS staff overseeing immigration procedures.

Five gay, binational couples file suit challenging DOMA

NEW YORK — Five gay couples on Monday filed suit in the Eastern District of New York, challenging Section 3 of the federal Defense of Marriage Act (DOMA), which prevents lesbian and gay American citizens from sponsoring their spouses for green cards.

The lawsuit, filed on the couples’ behalf by Immigration Equality, alleges that DOMA violates the couples’ constitutional right to equal protection.

NEWARK, N.J. – Henry and Josh have won a reprieve in their fight to stay together as a married couple in the United States.

Judge Alberto Riefkohl granted an adjournment in their case today in an immigration court in Newark.

Henry Velandia, 27, a salsa dancer from Venezuela, and Josh Vandiver, 29, a graduate student at Princeton, were legally married last year in Connecticut. They have been fighting the Defense of Marriage Act (DOMA), which would have forced the deportation of Velandia and broken up their marriage.

Immigration Equality hails government decision allowing gay couples to file green card applications

WASHINGTON -- Immigration Equality hailed an announcement today from U.S. Citizenship and Immigration Services (USCIS) that the agency will allow Americans with spouses from abroad to apply for green cards while courts weigh constitutional challenges to the federal Defense of Marriage Act (DOMA).

"USCIS has issued guidance to the field," agency spokesman Christopher Bentley said, "asking that related cases be held in abeyance while awaiting final guidance related to distinct legal issues."
