Restaurant pays $25,000 to LGBT patron after violent anti-gay attack

NEW YORK - Lambda Legal client Liza Friedlander, who was violently attacked while trying to dine with friends at a Forest Hills restaurant owned by defendant Waroge Met, Ltd., doing business as Sizzler Restaurant 0489, recently recovered $25,000 in a lawsuit filed in Queens County in 2011.

The court entered a judgment against the defendant Sizzler Restaurant 0489 and its manager, defendant Edgar Orellana, after those defendants offered to allow judgment to be taken against them.

Court: HIV-positive man's spitting is not aggravated assault

NEW YORK -- New York Court of Appeals today dismissed an aggravated assault conviction based on HIV status and remitted the case back to Herkimer County Court for resentencing.

"This is a terrific development. The Court clarified that saliva - like other body parts - cannot be considered a dangerous instrument under New York penal law," said Scott Schoettes, HIV Project Director at Lambda Legal.

UPDATED BREAKING NEWS: Another federal court rules DOMA unconstitutional

NEW YORK -- Yet another federal court has ruled the so-called Defense of Marriage Act, aka DOMA, is unconstitutional.

The First Circuit Court of Appeals in New York upheld a lower court ruling that found DOMA was unconstitutional, sticking another hole in the federal law that discriminates against legally married gay and lesbian couples.

The ruling by a three-judge panel was authored by Judge Michael Boudin, who was nominated by President George H.W. Bush, a Republican. It involves two closely-watched cases:

WAYNESVILLE, Ohio -- The U.S. District Court for the Southern District of Ohio signed an agreed judgment order this week in favor of Maverick Couch, affirming the high school junior's First Amendment right to wear a T-shirt with the slogan "Jesus Is Not a Homophobe" to school on any day he chooses.

Maryland court: Out-of-state marriages will be recognized

ANNAPOLIS, Md. -- Lambda Legal and the National Center for Lesbian Rights applaud a ruling today by the Maryland Court of Appeals, the highest court in the state, granting a divorce to a same-sex couple, Virginia Cowan and Jessica Port, who were married outside of Maryland.

The 7-0 unanimous ruling declares that married same-sex couples are entitled to divorce under Maryland law.

New York appeals court urged to reject felony charge based on HIV status

NEW YORK -- Lambda Legal has filed a friend-of-the-court brief in the New York Court of Appeals urging the court to drop the aggravated assault charge leveled at a criminal defendant based on his HIV status.

"The last time I checked, being HIV-positive is not a crime," said Scott Schoettes, HIV Project director at Lambda Legal. "And a person should not face criminal punishment -- or, as in this case, significantly enhanced penalties -- simply because he or she happens to be living with HIV."

Judge: Gay student can wear ‘Jesus Is Not A Homophobe’ shirt for 1 day

WAYNESVILLE, Ohio — An openly gay Ohio teen, who is suing his school after being threatened with suspension for wearing a T-shirt containing the message “Jesus Is Not A Homophobe,” will be allowed to wear the shirt after all — but for 1 day only, a federal judge ruled this week.

In a conference with Judge Barrett of the U.S. District Court of the Southern District of Ohio, the Wayne Local School District agreed to permit 16-year-old Maverick Couch to wear his T-shirt on one day only, GLSEN’s National Day of Silence, while the case proceeds.

Federal court continues to bar Arizona from stripping family coverage for lesbian and gay state employees

SAN FRANCISCO -- The U.S. Ninth Circuit Court of Appeals on Tuesday denied the request of Arizona State officials for an en banc rehearing of an earlier ruling that maintains family health coverage for lesbian and gay State employees until a court issues a final decision in the case.

Lambda Legal represents nine lesbian and gay state employees -- including from the State Department of Game and Fish and state universities -- who are challenging a move by the Arizona Legislature to eliminate the equal health care coverage that they rely on to safeguard their families' health.
