BREAKING NEWS: DOMA ruled unconstitutional in California case

SAN FRANCISCO – The Defense of Marriage Act (DOMA) violates the U.S. Constitution’s equal protections clause, a federal judge ruled today in an important test case in California that could have national implications.

Lambda Legal just tweeted the breaking news, noting that this is the first DOMA-related ruling since the Justice Department said that the federal law is unconstitutional and that it would not defend it in court.

Tara Borelli, one of the lead attorneys in the case, said "This ruling spells doom for DOMA."

New Jersey court reinstates federal equal protection claim in marriage equality case

TRENTON, N.J. -- In response to the plaintiff's request for reconsideration, a New Jersey Superior Court today reinstated the federal equal protection claim in Lambda Legal's case seeking marriage equality on behalf of Garden State Equality and seven same-sex couples and their children harmed by the state's unequal civil union system.

Iowa agency sued after erasing lesbian mom's name from stillborn baby's death certificate

DES MOINES, Iowa -- Lambda Legal filed suit today against the Iowa Department of Public Health (IDPH) on behalf of Jenny and Jessica Buntemeyer, a married Iowa couple seeking an accurate death certificate for their stillborn baby, Brayden.

After the loss of their son, Jenny and Jessica filled out the spaces on the death certificate form for both parents, and indicated that they were married. IDPH sent the couple a death certificate with Jenny's name erased.

Eleventh Circuit Court rules in favor of HIV-positive man denied job as Atlanta police officer

ATLANTA -- The U.S. Court of Appeals for the Eleventh Circuit reversed a lower court ruling and remanded the case of Lambda Legal client, Richard Roe, back to district court on Wednesday.

Roe applied to be a police officer with the Atlanta Police Department (APD), but was denied employment because of his HIV status.

Eleventh Circuit hears case of HIV-positive man denied job as Atlanta police officer

ATLANTA -- Lambda Legal today urged the Eleventh Circuit Court of Appeals to overturn a lower court ruling against the claim of a man who applied to be a police officer with the Atlanta Police Department (APD), but was denied employment because of his HIV status.

"Not only does science not support what the APD is doing, but the fact is that people living with HIV are already serving as police officers all across the country. The City of Atlanta has to make decisions based on facts rather than bias," said Scott Schoettes, Lambda Legal's HIV Project Director.

Iowa court orders state to provide accurate birth certificate to child born to two mothers

DES MOINES, Iowa -- The Iowa District Court for Polk County on Wednesday, Jan. 4, ordered the state's Department of Public Health to issue a birth certificate for 2-year-old Mackenzie Gartner, a child born to a married same-sex couple in 2009, listing both spouses as Mackenzie's parents in reliance on their marriage and the spousal presumption of parentage it creates.

VIDEO: The Rev. Dr. Robert Franke, advocate against AIDS discrimination, dies at age 78

LITTLE ROCK, Ark. -- The Rev. Dr. Robert Franke, an advocate against AIDS discrimination who in October attended a White House meeting on HIV and aging, died on Dec. 26. He was 78.

Dr. Franke spoke from personal experience. The retired university provost, who was also a Unitarian-Universalist minister, was evicted from Parkstone Living Center’s assisted living facility, Fox Ridge of North Little Rock, because he had HIV.

In 2009, Lambda Legal took up the case, Franke v. Parkstone Living Center, which was settled in September 2010.

Civil union FAQ issued for Delaware same-sex couples

NEW YORK -- Lambda Legal and Equality Delaware today released a Frequently Asked Questions (FAQs) guide for same-sex couples in Delaware who are considering getting a civil union.

"We congratulate Delaware on the advent of civil unions. We know that a new civil union law can be confusing, so it is likely many families will have questions about what it all means. This FAQ will provide some clarification for Delaware residents who are wondering how civil unions can help protect their families," said Susan Sommer, director of constitutional litigation at Lambda Legal.

HIV and health advocates submit comments on CDC guidelines for organ donation

NEW YORK -- In comments submitted today to the Centers for Disease Control and Prevention (CDC), HIV and health advocates say they are pleased that the CDC is updating guidelines for organ donation to include more current scientific information about HIV, but urge the agency to do more to maximize the supply of organs available for transplantation from medically qualified donors throughout our society, including LGBT people.

Lambda Legal, the Gay & Lesbian Medical Association (GLMA), AIDS United and amfAR, The Foundation for AIDS Research submitted comments to the CDC.
