UPDATED BREAKING NEWS: Ninth Circuit deals another blow to Prop 8

SAN FRANCISCO – Dealing yet another blow to California’s Proposition 8, the Ninth Circuit Court of Appeals today declined a request for an en banc hearing by a larger panel of judges.

Proposition 8 plaintiffs urge Ninth Circuit to uphold public's right to view historic trial's video

SAN FRANCISCO – The plaintiffs in Perry v. Brown, the landmark federal constitutional challenge to California’s Proposition 8, late Monday filed a brief defending the public’s right to see the video recording of the historic public trial in this case.

The brief urges the Ninth Circuit Court of Appeals to affirm the District Court’s decision granting plaintiffs’ motion to unseal the digital recording of the trial.

Attacks against Proposition 8 trial judge are denounced

SAN FRANCISCO – Attorneys for the plaintiffs in Perry v. Brown filed a brief late Monday with the U.S. Court of Appeals for the Ninth Circuit answering claims by the proponents of Proposition 8 that the judge who struck down the discriminatory law – now-retired U.S. District Chief Judge Vaughn R. Walker – should have recused himself because he is gay and in a same-sex relationship.

AFER: Don't delay public's right to view historic Prop 8 trial video

SAN FRANCISCO – The plaintiffs in Perry v. Brown, the landmark federal lawsuit that found Proposition 8 unconstitutional, filed a brief late Monday in opposition to an emergency motion for a stay pending appeal.

American Foundation for Equal Rights (AFER) argued that "the public has an overriding interest in immediate access to the video recordings so that it can scrutinize for itself the full trial record as this closely watched case progresses through the appellate process."
