AFER legal eagles: We will win U.S. Supreme Court case on Prop 8

The legal eagles who successfully fought California’s Proposition 8 law said today they are confident of victory at the U.S. Supreme Court.

The dream team of Ted Olson and David Bois, along with attorney Ted Boutrous and the two gay couples who sued to overturn the discriminatory law, spoke immediately after news broke that the nation’s high court was going to take up the Prop 8 case, as well as one of the Defense of Marriage Act (DOMA) cases.

WASHINGTON – The waiting game continues for LGBT Americans in their quest to achieve full equality.

Once again, the U.S. Supreme Court leaves LGBT Americans hanging in the wind, wondering whether the justices will ever make a decision about the Proposition 8 and Defense of Marriage Act (DOMA) cases that are before them.

This morning, the high court announced its order list from last Friday's conference and it did not include any of the gay-rights issues.

No decision today by U.S. Supreme Court on Prop 8/DOMA cases

WASHINGTON – The U.S. Supreme Court did not place any of the gay rights cases on its orders today, adding to the incredible drama that is building up about whether the justices will take up California’s Proposition 8 and the nine DOMA cases.

The high court could also have decided not to take up any of the cases, which would have widespread implications for millions of LGBT Americans. If the justices let lower court rulings stand, Proposition 8 and DOMA would be dead.

At their Conference today, the Justices will consider petitions raising federal constitutional issues related to same-sex marriage. These are the most significant cases these nine Justices have ever considered, and probably that they will ever decide.

SDGLN Poll: Readers think nation's high court will take up Prop 8/DOMA cases

SAN DIEGO – A small majority of readers of San Diego Gay & Lesbian News who took our poll say they expect the U.S. Supreme Court to take up the Proposition 8 and DOMA cases.

Our poll question was: Will the U.S. Supreme Court will take up Prop 8/DOMA cases?

The results, which are not scientific, reveal that 53% of readers predict that the Supreme Court will take action on the Prop 8/DOMA cases and 47% don’t.

BREAKING NEWS: Supreme Court reschedules date to consider whether to hear Prop 8/DOMA cases

WASHINGTON -- The United States Supreme Court indicated today that it has rescheduled the date when it will consider whether to grant review in
Hollingsworth v. Perry (formerly Perry v. Brown), the federal constitutional challenge to California's Proposition 8.

The Perry case, along with several cases challenging the federal Defense of Marriage Act (DOMA), have been distributed for consideration at the Justices' private Conference scheduled for Friday, Nov. 30. The Proposition 8 and DOMA cases had previously been distributed for the Conference of Tuesday, Nov. 20.

WASHINGTON -- The U.S. Supreme Court this morning indicated that it will consider whether to grant review in Hollingsworth v. Perry (formerly Perry v. Brown), the federal constitutional challenge to California's Proposition 8.

No news on Prop 8, DOMA cases today at the U.S. Supreme Court

WASHINGTON – For the fourth consecutive week, the U.S. Supreme Court did not take any action regarding California’s Proposition 8 or a handful of Defense of Marriage (DOMA) cases that are under consideration.

Today, the nation’s high court concluded its October sitting without addressing Prop 8 or DOMA. The court will conference next on Friday, Oct. 26 and make announcements regarding that meeting when the November sitting begins on Monday, Oct. 29.
